Terms of Service

These terms are an agreement between you and 1956 US LLC ("Bobb," "we," "us") covering your use of the Bobb platform. By creating an account or using Bobb, you agree to them.

1. The service

Bobb is a growth platform with two agents. The outbound agent finds business prospects and sends cold email on your behalf. The newsletter agent writes and sends a newsletter to your own list and surfaces sales conversations from it. We may add, change, or remove features over time as the product develops.

2. Your account

You must provide accurate information, keep your credentials secure, and be responsible for activity under your account. You must be at least 18 and able to enter a binding contract. If you use Bobb on behalf of an organization, you represent that you're authorized to bind it to these terms.

3. Acceptable use

You agree that you will not use Bobb, or instruct its agents, to create or send content that:

  • Is illegal, fraudulent, defamatory, obscene, threatening, abusive, or otherwise unlawful where you or your recipients are located.
  • Infringes anyone's intellectual property, privacy, or other rights.
  • Contains malware, phishing links, deceptive URLs, or anything designed to defraud, mislead, or harm recipients.
  • Promotes violence, hate speech, discrimination, or any activity the law prohibits.
  • Is spam that violates applicable anti-spam law.
  • Impersonates any person or business, or misrepresents who you are.

Newsletter sending is permission-based. Only send your newsletter to people who have a relationship with you or were otherwise lawfully added. Honor unsubscribe requests promptly, and don't upload purchased lists to your newsletter.

We monitor for abuse and may pause sending, suspend, or terminate accounts that put deliverability, the network, recipients, or other customers at risk.

4. Outbound prospecting and cold email

The outbound agent contacts business prospects who have not opted in to hear from you. When you use it, you are the data controller (or the equivalent under local law) for the personal data it processes, and you are the sender of every message. By starting a search, launching a campaign, or otherwise instructing the agent to work, you confirm that:

  • You have a valid legal basis for the outreach, such as legitimate interest for business-to-business communication, and have completed any assessment the law requires before sending.
  • Your outreach complies with the laws where you operate and where your recipients are, including CAN-SPAM (United States), CASL (Canada), the GDPR and ePrivacy Directive (European Union), and the UK GDPR, Data Protection Act 2018, and PECR (United Kingdom). You can exclude countries from any campaign.
  • You will contact business addresses about business matters, use an honest sender identity and subject line, and include a working way to opt out.
  • You will honor opt-outs immediately, keep a suppression list, and never contact someone again after they object.
  • You will answer requests from the people you contact (access, deletion, correction, objection) within the time the law requires, typically 30 days.

You are solely responsible for the content you provide, the instructions you give the agent, and every message the agent writes or sends on your behalf. You can preview leads and messages before launch, and Bobb does not review, approve, or endorse them. Bobb is not liable for any fines, penalties, claims, or losses arising from your outreach or from your failure to comply with data-protection or marketing laws.

Prospect data the outbound agent provides comes from publicly accessible business sources. It is licensed to you only for your own outreach through Bobb. You may not resell it or use it to build a competing data product.

5. Your content and data

You own your content, your newsletter contacts, and your archive. You grant us the limited license needed to host, process, and send them on your behalf. You can export your newsletter list and content at any time. We're not interested in lock-in. You are responsible for having the rights and consents necessary for the contacts you upload.

6. Fees and billing

Subscription plans are billed in advance on the cycle you select (monthly or annual). Plans and pricing are described on our pricing page. Subscription fees are non-refundable, including fees for annual plans, except where required by law. If you cancel, you keep access through the end of the term you've paid for.

Pay-as-you-go usage. Outbound email beyond what your plan includes is charged per email sent, at the rates on our pricing page. To use it, you save a payment method. Usage can build up as a balance up to a limit we set for your account, and you authorize us to charge your saved payment method for that usage without you being present, including retrying failed charges. If we can't collect a balance, we may pause sending until it is paid. Usage charges pay for emails already sent, so they are final and not refundable. You can set a daily budget cap in the app.

We may change pricing with reasonable notice. Changes don't apply to a term you've already prepaid.

7. Credits, trials, and estimates

Free trials, welcome credits, and promotional credits are offered on the terms shown at signup. They have no cash value and are not refundable. We may change or end promotional offers going forward.

Our pricing page, calculators, and marketing may show estimated or typical leads, meetings, replies, or revenue. These are estimates based on past averages, not promises. Bobb does not guarantee any number of leads, meetings, sales, or any amount of revenue. Your results depend on your offer, market, list, and sales process, and may be lower or zero.

8. Third-party services

Bobb integrates with third-party services (prospect data, email delivery, payments, hosting, analytics, and optional self-host keys you provide). Your use of those services is also subject to their terms, and we're not responsible for their acts or omissions.

9. Availability

We work to keep Bobb available and reliable but don't guarantee uninterrupted service. We may perform maintenance and may change or discontinue features.

10. Termination

You can cancel anytime from your account. We may suspend or terminate access for breach of these terms, non-payment, or activity that endangers the platform or others. On termination you may export your data for a reasonable period. We may retain data after termination as described in our Privacy Policy.

11. Disclaimers

Bobb is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant specific deliverability, open, click, reply, lead, meeting, or revenue results. Content our agents write is AI-generated and may contain errors, so review it before you rely on it. We don't control whether recipients open, reply, meet, or buy.

12. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

13. Indemnification

You agree to indemnify, defend, and hold us harmless from claims, fines, penalties, and costs (including reasonable attorneys' fees) arising out of your content, your contacts, the outreach the agents send on your behalf, your misuse of the service, or your violation of these terms or applicable law.

14. Dispute resolution and arbitration

Most concerns can be resolved by emailing us first. If a dispute can't be resolved informally, you and Bobb agree to resolve it through binding individual arbitration rather than in court, and you and Bobb each waive the right to participate in a class or representative action, to the extent permitted by law. Either party may still bring a qualifying claim in small-claims court.

15. Governing law

These terms are governed by the laws of the State of Nevada and applicable U.S. federal law, without regard to conflict-of-laws rules.

16. Changes to these terms

We may update these terms as the product and law evolve. Material changes will be reflected in the date above and, where appropriate, communicated to customers. Continued use after an update means you accept the revised terms.
